Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the services provided by Boykin Web Management (“we,” “us,” or “our”) and your access to boykinwebmanagement.com(the “Site”). By engaging our services or using the Site, you agree to these Terms.

Services

Boykin Web Management provides website design, website development, search engine optimization (SEO), conversion rate optimization, ecommerce solutions, and website maintenance services to businesses. The specific scope, deliverables, and pricing for each engagement are agreed upon prior to the start of work.

Website Care Plan

This section applies to the Website Care Plan, the subscription sold at boykinwebmanagement.com/start. Where it differs from the general terms on this page, this section governs.

What the plan includes

A custom website for your business with a home page, an about page, a services page, a page for each of your services up to 10, and a contact page; search engine optimization on each page; a design that works on phones, tablets and computers; hosting; and one batch of edits each month. A batch of edits is one list of changes sent together; unused batches do not carry over.

What the plan does not include

Business email; registering, renewing, transferring or managing domain names; more than one batch of edits a month; more than 10 service pages; and new features such as online stores, booking systems or member areas. We will tell you before starting if a request falls outside the plan.

Renewal

Your plan renews automatically, monthly or yearly, until you cancel.

Cancelling

Cancel anytime online. Your site stays live through the period you've already paid for.You can cancel from the link in your receipt email or the “Manage or cancel your plan” link on the sign-up page, without contacting us.

Refunds

If you cancel within 30 days of your first payment, you get that payment back in full. After that, cancelling stops future renewals, and payments already made aren't refunded.

Ownership

Your domain is always yours. If you cancel before you've paid for 12 months, the website design stays with Boykin Web Management, or you can keep it by paying the rest of your first year. After 12 paid months, it's yours to keep.Paying the rest of your first year means paying the monthly price for each month remaining until you have paid for 12. When the plan ends, hosting ends. If you own the design, we will send you the site’s files on request.

Your domain

You register, pay for and control your own domain name. We never need your domain account password; we send you the settings to connect it to the site.

No Long-Term Contracts

We do not require long-term contracts. You may cancel your service at any time by providing written notice via email. Your service will remain active through the end of the current billing cycle. After that period, your website or associated services may be removed or deactivated unless alternative arrangements are made.

Payments

Payment terms are outlined in your service agreement or proposal. Invoices are due upon receipt unless otherwise agreed in writing. Work will not commence or continue on projects with outstanding balances beyond the agreed payment terms.

Refund Policy

We stand behind our work. If you are not satisfied with the services provided, you are entitled to a full refund within 30 days of the initial payment. After 30 days, cancellations are permitted but refunds will not be issued for work already completed or time already invested.

Client Responsibilities

To deliver your project on time, we depend on timely feedback, content, and approvals from you. Delays caused by late responses or missing materials may affect project timelines. You are responsible for ensuring that any content, images, or materials you provide do not infringe on any third-party intellectual property rights.

Intellectual Property

Upon receipt of full payment, you own the final website design and custom code we create for you. We retain the right to display the completed work in our portfolio and marketing materials unless you request otherwise in writing. Third-party assets (fonts, stock images, plugins, themes) remain subject to their respective licenses.

Website Maintenance & Hosting

If you engage us for ongoing website maintenance or management, we will use commercially reasonable efforts to keep your site secure, updated, and operational. We are not liable for downtime caused by third-party hosting providers, domain registrars, or circumstances outside our control.

Limitation of Liability

To the fullest extent permitted by law, Boykin Web Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or the Site, including but not limited to loss of revenue, loss of data, or loss of business opportunities. Our total liability for any claim arising from our services shall not exceed the amount you paid us in the 30 days preceding the claim.

Disclaimer of Warranties

Our services are provided “as is” without warranties of any kind, express or implied. We do not guarantee specific search engine rankings, advertising results, or business outcomes. Results vary based on many factors outside our control, including market conditions, competition, and search engine algorithm changes.

Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration in the state where Boykin Web Management is registered.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
